A Colorado man is trying to take the Rockies to court nearly two years after attending a game at Coors Field.

July 2023 Game: Rockies vs Yankees Ends in More Than a Victory

On July 16th, 2023 the Rockies took on the New York Yankees and won 8-7. While that was a great game for the team, Timothy Roeckel of Parker wasn't celebrating the victory.

Fan Struck in the Face by Foul Ball at Coors Field

At the bottom of the first inning, a player from the Colorado team hit a foul ball that hit Roeckel in the face and right eye, according to the Denver Post.

Ouch! 

He was sitting in the luxury box as a guest at the time of the incident.

Lawsuit Alleges Permanent Injury and Rockies’ Negligence

Now, this man is suing the team for negligence, claiming he suffered "catastrophic and permanent injuries." The lawsuit even puts part of the blame for this on the Rockies' poor performance.

Lawsuit Claims Rockies' Bad Performance Distracts Spectators

The law is typically on the side of the major league team and stadiums. They're usually protected from any liability from injuries during games. This guy's lawyer is actually claiming that the stadium officials did not do enough to keep the fans safe during games.

The team's "longstanding poor performance" has allegedly caused Coors Field to have an, "environment in which spectators, particularly those in luxury suites, are less engaged with the action on the field,” the man's attorneys claimed.

Jury Trial Sought and Damages Requested in Rockies Lawsuit

Roeckel's legal team wants this to go to jury trial and are seeking an undisclosed amount in damages, reports say.
