You Can Be Fined For Holding a Phone While Driving in Colorado in 2025
A new year means new laws in Colorado. Starting in 2025, if you are caught holding your phone while driving in the state, you could be fined. Colorado has had a law on the books for years regarding texting and driving and this new law takes it a step further for the sake of safe driving.

Governor Jared Polis signed the Mobile Electronic Devices and Motor Driving bill in June. Senate Bill 24-065 outlaws the use of mobile electronic devices by drivers in Colorado unless they are using hands-free devices.
There are some exceptions to this new law, however. Those exceptions include:
- An individual contacting a public safety entity
- An individual during an emergency
- An employee or contractor of a utility when responding to a utility emergency
- An employee or contractor of a city or county acting within the scope of the employee's or contractor's duties as a code enforcement officer or animal protection officer
- A first responder
How much could you be fined for using your phone while driving in Colorado in 2025?
To be fined for using your phone while driving in Colorado, a law enforcement officer must see the driver in the act of using a mobile device in a manner that would be considered careless or imprudent.
The first offense for being caught using a mobile device while driving is a $75 fine and two license suspension points. The second offense within 24 months is a $150 fine and three license points. The third offense within 24 months is a $250 fine and four license points.
